GENERAL RENTAL CONDITIONS

Introduction

These General Rental Conditions (GTC) govern the vehicle rental service contract that binds You to Atlanti Camper. By ticking the “I accept” box during the reservation procedure, You accept the terms without reservation of any kind. We therefore recommend that you read them carefully. Atlanti Camper reserves the right to modify these terms and conditions at any time without notice. In the event of modification, the applicable conditions will remain those in force on the day of the Tenant's reservation request.

 

 

1) - Terms & Definitions

"Renter" means the natural or legal person in whose name the rental contract is established as well as the drivers mentioned on the rental contract. If the renter is a natural person, he is also the main driver and the signatory of the contract. If the tenant is a legal person (examples: company, association, etc.) then the main driver is the signatory of the contract.

"Atlanti Camper", "Rentor" and "Agency" means the company Atlanti Camper.

“Vehicle” means the rented vehicle.

"Contract" means the rental agreement concluded between the Lessor and the Lessee, subject to these general rental conditions.

 

 

2) - Conditions related to the Tenant

The name of the Renter indicated on the rental contract is that of the main driver, who must be present when signing the said contract and to whom the costs related to the rental will be invoiced. It is possible to add additional drivers who will be mentioned in the rental contract subject to the payment of a supplement per driver. Except for legitimate and unforeseeable reasons, only the drivers mentioned in the rental contract are authorized to drive the Vehicle.

The Tenant, to rent from Atlanti Camper, must be at least 18 (eighteen) years old and have a B license (VL tourism).

The Tenant will be required to present at the signing of the rental agreement:

  • A valid identity document;

  • A valid valid license. Permits issued outside the European Union must be written in French or accompanied by an official translation; if not, an international permit must accompany the original permit;

  • A means of payment to pay for the rental;

  • An international bank card in his name for the payment of the security deposit – amount not collected during the rental (see article 9).

 

In the event of non-presentation of these documents, Atlanti Camper reserves the right not to rent the vehicle. Atlanti Camper also reserves the right not to rent the vehicle on the day of picking up the vehicle if the Renter cannot prove that he is of the minimum age required,  and/or not having a valid driver's license in his possession, and/or not being able to pay the deposit. In any case, Atlanti Camper cannot be held responsible for this refusal to rent and will not grant any compensation.

In the event that the Renter has his license withdrawn during the rental or in the event that his number of points becomes zero rendering his license invalid, and if there is no second driver indicated in the rental contract, the Tenant will have to repatriate the vehicle at his own expense and all expenses that may be incurred in this context will remain his responsibility.

The Renter and the authorized drivers are liable to the Lessor for the full execution of these rental conditions. As soon as the Vehicle is made available and until it is returned, the Tenant becomes totally responsible for it under the terms of article 1384 of the Civil Code. The Lessor reserves the right to terminate the rental immediately and automatically without justification or compensation in the event of violation by the Lessee of one of the essential obligations of the rental contract, in particular the conditions of use of the Vehicle, the payment and return conditions.

 

 

3) - Rental rates

The applicable rental rates are those communicated by Atlanti Camper at the time of booking, and recalled on the rental contract. The prices displayed are indicated in euros all taxes included (French VAT and other applicable taxes where applicable). Atlanti Camper reserves the right to modify its prices at any time.

Once payment of the deposit has been made, the price of the vehicle rental is firm and guaranteed and will no longer be modifiable by Atlanti Camper, including in the event of a fluctuation in the exchange rate. In fact, after payment of the deposit requested by Atlanti Camper when booking, the Tenant cannot request a change in the price paid in the event of promotional offers offered by Atlanti Camper, after said payment.

Rental rates are calculated according to the information provided by the Tenant when booking. Any subsequent modification of a reservation may lead to a change in the rental price (see article 5).

 

The rental price indicated when booking includes:

  • A mileage package calculated on the basis of the number of rental days (specified on the rental contract);

  • Compulsory insurance: third party / civil liability;

  • Additional insurance: theft and fire with deductible;

  • Local taxes (VAT);

  • The options taken out at the time of booking (deposit reduction, second driver, etc.).

 

This price does not include:

  • Fuel ;

  • Any excess mileage;

  • The deposit to be paid by international credit card in the name of the main driver, regardless of the additional insurance taken out;

  • Damage not covered by insurance, in particular the interior of the vehicle or in the event of a puncture;

  • The excess amount debited by Atlanti Camper in the event of an at-fault accident or damage to the vehicle without a known third party;

  • Any damage to the vehicle in the absence of an amicable accident report;

  • Time overruns resulting in a penalty set by Atlanti Camper resulting in additional invoicing;

  • The amount of the fines as well as the inherent administrative costs. The Tenant remains solely responsible for fines, fines and reports established against him and also for any customs prosecution;

  • Any costs for interior and exterior cleaning of the vehicle.

 

 

4) - Reservation and payment

By accepting these Terms and Conditions, the Renter expressly authorizes Atlanti Camper to charge his credit, payment or debit card for the amounts corresponding to the Atlanti Camper rental services. The Renter also authorizes Atlanti Camper to debit his card for any additional charges mentioned in this contract.

At the time of booking, on the website www.atlanticamper.com or in an Agency, the Renter must pay 50% (fifty percent) of the total price corresponding to the rental services. The remainder of the Atlanti Camper service, ie the remaining 50% (fifty percent) due, must be paid when taking possession of the rented Vehicle, at the headquarters of the Atlanti Camper Agency.

The total invoicing price includes the amount of the rental (VAT included) for: the category of Vehicle, the dates, the optional services payable online (additional equipment, Additional Insurance Pack, etc.) as well as the elements included in the prices at the time of booking, at the rates indicated by Atlanti Camper. Any other equipment and optional service to which the Tenant wishes to subscribe after the reservation will be paid directly to the Agency, when taking possession of the Vehicle.

The Renter also authorizes Atlanti Camper to debit his credit, payment or debit card for any additional costs at the end of the rental, in the event of missing fuel or mileage greater than the package subscribed according to the rates stipulated in the contract. rent. The number of kilometers traveled during the term of the rental contract is that indicated by the meter of the Vehicle. If the odometer has not worked for a reason other than a technical failure, the Renter will have to pay the mileage allowance on the basis of 200 (two hundred) kilometers per rental day. In the event of a violation of the Highway Code, Atlanti Camper also reserves the right to charge administrative fees (cf. article 17).

In the event of non-payment or non-payment, the Lessee expressly accepts the forfeiture of the term for invoices not due and the termination of the contract as of right, as well as the immediate return of the Vehicles being rented.

If the payment deadline (due date of the invoice) is exceeded, the Tenant will be liable for a late payment penalty on the amount due calculated at the legal interest rate in force plus 10% (ten percent). In addition, the Tenant authorizes Atlanti Camper to debit the security deposit (see article 9) to recover the amount due.

 

 

5) - Modification or cancellation of the reservation

The Tenant can modify or cancel his reservation according to the conditions below:

  • For any modification, if the price of the modified rental is higher than the initial total amount to be paid, the difference will be invoiced and must be paid when taking possession of the Vehicle. If the price of the modified reservation is lower than the initial total amount, the Renter will not be reimbursed for the difference.

  • If a cancellation request is made more than 1 (one) month before picking up the vehicle or more than 15 (fifteen) days in the context of a health crisis linked to COVID-19, a fixed file management fee of an amount of €30 (thirty euros) including tax will be invoiced to the customer and kept on the deposit paid. The rest of the deposit will be refunded (cf. article 8).

  • If a cancellation request occurs less than 1 (one) month before picking up the vehicle or less than 15 (fifteen) days in the context of a health crisis linked to COVID-19, cancellation fees will be applied. These costs amount to the first payment made at the time of booking, ie 50% (fifty percent) of the total amount. If the Renter does not take possession of his vehicle within 24 (twenty-four) hours of the reservation date mentioned in his reservation, this will be worth cancellation on his part.

  • In the event of confinement in the context of a health crisis linked to COVID-19, all reservations will be automatically cancelled. Atlanti Camper undertakes to fully reimburse the sums received as the deposit paid by the Tenant (see article 8).

 

 

6) - Extension of the rental

To extend the rental of the Vehicle, the Lessee must contact the Lessor at least 48 (forty eight) hours before the return date. The request for extension of the rental must be accompanied by the necessary provision, under penalty of exposing oneself to civil and criminal legal proceedings for misappropriation of the Vehicle.

The Lessor reserves the right to refuse the extension, without compensation for the Lessee, with the obligation for the latter to return the Vehicle on the date initially scheduled.

 

 

7) - Unavailability of the Vehicle

In the event that Atlanti Camper finds itself unable to rent the Vehicle to the Renter on the scheduled rental date, Atlanti Camper undertakes to fully reimburse the sums received as the deposit paid by the Renter (cf. section 8).

Under no circumstances, the Tenant can claim damages for the cancellation of the rental or the immobilization in the case of repairs during the rental. Atlanti Camper cannot therefore be held liable for any loss and/or damage suffered by the Tenant resulting from this cancellation.

 

 

8) - Refund

In the event of cancellation of reservation in cases giving rise to the right to reimbursement, in accordance with these general conditions of use, the reimbursement will be made within a maximum of 21 (twenty-one) days following the date of cancellation by credit the credit card used when booking, by check or by bank transfer addressed to the name of the Tenant and to the address indicated when booking.

 

 

9) - Security deposit / Deposit

The amount of the security deposit corresponds to the deductible of the insurance Pack contracted, either Basic, Medium or Premium. It amounts respectively to €2,000 (two thousand euros) including tax, €1,000 (one thousand euros) including tax or €500 (five hundred euros) including tax. The amount of the security deposit is not cashed during the rental period. It is intended to guarantee Atlanti Camper the payment of the rental, increased if necessary by the financial responsibility for which the Renter could be liable in the event of damage (s) suffered by the Vehicle or in the event of theft.

The security deposit is returned 10 (ten) days maximum after the return of the Vehicle, this period may be extended until full payment by the Renter of the following possible costs:

  • Vehicle repair costs;

  • Tickets and administrative processing fees;

  • Add fuel;

  • Excess mileage charge: €0.35 (thirty-five cents) including tax per additional kilometer;

  • Cleaning costs;

  • Late penalties in case of late return of the vehicle.

 

The Renter authorizes Atlanti Camper to immediately debit all or part of the security deposit to cover these costs. Following material damage, if these require expertise from a repairer or bodybuilder, an invoice will be drawn up and sent to the Tenant after his return date. This invoice will give rise either to an additional payment by the tenant, or to a reimbursement from Atlanti Camper in the case of an overpayment.

 

 

10) - Vehicle condition

The Vehicle is delivered in apparent good working order and fitted with tires in good condition. By signing the contract, the Renter accepts the Vehicle in the state in which it is and undertakes to return it in the same state. A descriptive statement of the Vehicle is attached to the contract, indicating any visible damage, the number of kilometers traveled and the fuel level.

The Tenant undertakes to check before leaving the Agency that the condition of the Vehicle corresponds to the description. If necessary, the Tenant must report it to the Lessor. Failing this, the Vehicle will be considered as conforming to the description. Atlanti Camper will not take into account complaints concerning visible damage that has not been reported on the description.

Atlanti Camper provides the Tenant with a Vehicle with a full tank of fuel. The Renter is invited to return the Vehicle with a full tank of fuel. Failing this, the missing fuel will be invoiced to him on his return, in accordance with the provisions established on the Rental Agreement.

 

 

11) - Use of the vehicle

The Tenant agrees to:

  • Allow the Vehicle to be driven only by the drivers mentioned in the rental contract;

  • Use and maintain the Vehicle reasonably, under normal conditions of use;

  • Return the Vehicle in the same state of cleanliness as when it was taken possession of, namely a perfect state of cleanliness inside and outside. Otherwise, the Lessor reserves the right to charge cleaning fees;

  • Use non-abrasive materials for cleaning the interior or exterior of the Vehicle;

  • Travel only on roads suitable for car traffic;

  • Do not travel outside member countries of the European Economic Area. In the event of non-compliance with this territory, the Renter will not be able to claim the benefit of the Insurance guarantee and will be fully responsible for any damage, loss or theft;

  • Use the Vehicle in accordance with the provisions of the Highway Code and more generally in accordance with the legal and regulatory provisions of the country in which it is driving;

  • Do not hitch other vehicles, trailers or any other object and do not make any modifications to the Vehicle without the prior express written consent of the Lessor;

  • Do not overload the Vehicle;

  • Lock the Vehicle when it is parked and use any alarm and/or anti-theft devices with which it is fitted;

  • Do not accommodate animals on board the Vehicle without the prior express written consent of the Lessor;

  • Do not smoke or vape in the Vehicle;

  • Not use the Vehicle under the influence of an alcoholic state or under the influence of narcotics or any other substance affecting consciousness or the ability to react;

  • Not to transport goods or objects prohibited by the legislation in force in the country or countries where the vehicle is traveling during the rental;

  • Not subletting the Vehicle, transporting passengers for a fee or in excess of the number of seats in the Vehicle;

  • Do not use the Vehicle for illicit, immoral or unintended purposes by the manufacturer.

 

 

12) – Vehicle maintenance

Routine maintenance of the Vehicle is the responsibility of the Renter. Thus, depending on the number of kilometers traveled during the rental, the Tenant will have to carry out the usual checks according to the manufacturer's recommendations (engine oil level beyond 1000 (one thousand) kilometers, tire pressure, etc. ). The Tenant must always remain vigilant to the signals emitted by the warning lights, and take the associated measures such as a possible emergency stop. The maintenance and use manuals for the Vehicle are available at the Agency on request.

 

 

13) - Breakdowns, accidents and thefts

In the event of an incident or breakdown of the van, it is the responsibility of the Tenant:

  • Notify the Lessor immediately, so that the latter can initiate the assistance procedure, if necessary;

  • Not to carry out any repair or replacement of part, without the prior express written consent of the Lessor;

  • To establish and keep, in the case of repairs or replacement of parts carried out with the agreement of the Lessor, the invoices in the name of the Lessor.

 

In the event of a breakdown not attributable to the Renter, Atlanti Camper undertakes to bear all the costs of breakdown assistance and repair of the Vehicle, as well as to reimburse the Renter the full amount relating to the rental days not still expired.

 

In the event of a vehicle accident involving a third party, it is the Renter's responsibility:

  • To complete an amicable insurance report, even if the vehicle does not show any apparent damage (otherwise the tenant will be held responsible), allowing:

    • Identify the conditions of the disaster, and the responsibilities of the different parties (Tenant and third parties);

    • To identify the third party: name, telephone number, driver's license number, registration number.

  • Notify the Lessor immediately, so that the latter can:

    • Declare the claim to the insurance within 48 (forty-eight) hours;

    • Initiate the assistance procedure, if necessary.

 

In the event of damage caused to the Vehicle, the Tenant will have to pay administrative processing costs amounting to €30 (thirty euros) including tax and immobilization costs calculated according to the category of the Vehicle, reimbursable in the event that its responsibility would not be engaged.

 

In the event of theft, or attempted break-in resulting in damage to the van, it is the responsibility of the Tenant:

  • To notify the Lessor immediately so that the declaration of theft or attempted break-in and theft is made, by the Lessor, to the insurance within 48 (forty-eight) hours;

  • To file, within 24 (twenty-four) hours of the facts, a complaint at the police station or the gendarmerie closest to the place of the theft. You will be given a report (minutes) of your declaration. This approach makes it possible to trigger searches. It will also be the way to clear your responsibility if the thief causes an accident.

 

 

14) - Insurance and assistance

Atlanti Camper Vehicles are insured against all risks in all member countries of the European Union, the General and Special Conditions of this insurance contract are available in the agency and a copy of these Conditions can be sent on simple request from the Tenant.

 

The guarantee applies under the conditions provided for in the said General Conditions, and in particular to the following risks:

  • Civil liability without limitation of amount;

  • Damage to all accidents to the Vehicle with an excess of €2,000 (two thousand euros) including tax per damage;

  • Natural disasters ;

  • Fire, theft, attempted theft and vandalism with an excess of €2,000 (two thousand euros) including tax;

  • Glass breakage with deductible of €200 (two hundred euros) including tax per replacement, if the glass breakage can be repaired without the need for replacement, no deductible is applied;

  • Flat-rate additional protection for the driver and passengers up to €250,000 (two hundred and fifty thousand euros) including tax.

 

The warranty does not apply for:

  • The puncture of the tires, unless it is consecutive or concomitant with damage to the insured Vehicle;

  • The Tenant's personal effects, goods and animals;

  • The Tenant's negligence such as: breakdowns by mistake or lack of fuel, the Vehicle closed with the keys inside, the loss or breakage of the keys...

 

The Vehicle is only insured for the duration of the rental indicated on the contract. After this period, unless the extension of the duration of the rental is accepted in writing by the Lessor (see article 6), the Lessee will be solely responsible for the damage caused and/or suffered by the Vehicle.

 

The deductible is the maximum amount remaining payable by the Renter when the damage to the Vehicle is covered by the insurance. Its amount is €2,000 (two thousand euros) with the “Basic Pack” included for all rentals.

It is not to be confused with the amount or amounts that the Lessor reserves the right to claim from the tenant, in the event of damage not covered by the insurance.

The Tenant has the option of subscribing to the “Medium Pack” or “Premium Pack” options, respectively reducing the amount of the deductible to €1,000 (one thousand euros) including tax or €500 (five hundred euros) including tax.

Thus, in the event of a claim (covered by the insurance policies taken out by Atlanti Camper), the maximum sum payable by Atlanti Camper will amount to the amount of the deductible reduced to €1,000 (one thousand euros) including tax or €500 (five hundred euros) including tax, depending on the option contracted.

 

 

In the event of a breakdown or accident occurring during the rental and immobilizing the Vehicle, the Renter benefits from the 24/7 assistance service approved by Atlanti Camper and valid in all member countries of the European Union. This assistance covers:

  • Towing costs to the garage of the nearest Vehicle dealer within the limit of €300 (three hundred euros) including tax;

  • Transportation (return to the driver's and passengers' homes) by: rental vehicle, train, plane (economy class) or taxi over a distance of 100 (one hundred) kilometers;

  • Payment of hotel costs: 1 (one) night maximum in France and 3 (three) nights maximum abroad;

  • If applicable, the costs of repatriating the Vehicle and the people transported to the starting point of the rental.

 

All assistance costs that may be generated following an incident under the responsibility of the Tenant (or the driver of the Vehicle) will be entirely at his expense, in particular the repatriation of the Vehicle to the Atlanti Camper Agency.

 

15) - Forfeiture of warranty

Failure to comply with the Contract and these general rental conditions will result in the forfeiture of the contractual guarantees taken out. The Tenant will then be responsible for the entire loss under the conditions of the common law of liability.

 

 

16) - Return of the Vehicle

The rental ends with the return of the Vehicle, its keys, its original papers and accessories rented to the Atlanti Camper Agency, to an Atlanti Camper employee, on the return date and time stipulated in the Rental Agreement. Only this step allows you to end the rental contract.

In the event of the return of the Vehicle outside the times defined in the Rental Agreement, and without the intervention of an Atlanti Camper employee, the Renter will assume custody of it, the related risks and the cost of the rental until opening hours. opening of the agency.

In the event of a delay in returning the Vehicle, which may cause complications for the provision of subsequent customers, fees will be applied for an amount of €140 (one hundred and forty euros) including tax per hour of overrun.

The Vehicle must be returned in the same condition as when it was taken possession of by the Tenant, namely a perfect state of cleanliness inside (floors, seats, surfaces, crockery, cooler or refrigerator and waste water tank) and outside. Otherwise, the lessor reserves the right to charge cleaning fees.

 

 

17) – Tickets / Fines

The tenant is responsible for offenses committed during the term of the rental. In the event of receipt of the report (minutes) by Atlanti Camper, administrative processing costs amounting to €20 (twenty euros) including tax per violation/fine will be invoiced to the Tenant. Pursuant to article L121-2 and L121-3, Atlanti Camper will communicate the contact details of the Tenant to the Police Court which will send him a notice of violation.

 

 

18) - Declaration of acceptance of risks and disclaimer

Atlanti Camper shall in no event be liable to the hirer or any other licensed driver for loss or damage to personal property left on board the vehicle during the rental period and thereafter. The Renter and/or approved driver alone assumes all the risks relating to these goods.

Atlanti Camper authorizes free parking of the Tenant's vehicle within their premises. In this context, the Tenant is informed and accepts that the parking of his vehicle within the premises of the company Atlanti Camper is only authorized for the duration of the Rental. The Tenant is informed and accepts that the company Atlanti Camper can move his vehicle in the event of a claim, of presumed danger or for any other reason made necessary by the needs of the operation. The Tenant is informed and accepts that the company Atlanti Camper can in no way be considered as depositary of this vehicle and its contents and cannot be held liable in the event of damage or theft of the vehicle or its contents. In addition, the Tenant undertakes to ensure that his vehicle is always insured, to justify this at the first request of the company Atlanti Camper, and more generally to respect all the legal and regulatory insurance obligations in his charge.

Atlanti Camper cannot be held liable to the Renter or any third party for any loss or damage resulting from the rental, except exclusively in the event of negligence or gross negligence on its part, or any other breach of the terms of these general rental conditions. . Atlanti Camper cannot be held responsible for any indirect or unforeseeable damage. This provision does not exclude or limit Atlanti Camper's liability for death or personal injury resulting from its acts or omissions, nor for any other liability which the law provides cannot be excluded.

Atlanti Camper cannot be held liable in the event of a breach of its contractual obligations due to a fortuitous event or a case of force majeure as defined by case law.

 

 

19) - Data Protection Act

Pursuant to Law No. 78-17 of January 6, 1978 relating to files, computers and freedoms, the Tenant is informed that Atlanti Camper holds a personal data file collected when signing the rental contract. They are subject to processing allowing Atlanti Camper to manage the rental and related operations, in particular invoicing, and to send the Tenant, if necessary, commercial information.

They are intended, in whole or in part, for the company Atlanti Camper and its partners.

In addition, Atlanti Camper has installed in some of its vehicles a system to locate them in real time in order to facilitate the management of theft and loss of vehicles. By signing the Rental Agreement, the Renter authorizes Atlanti Camper to collect through the on-board geolocation system and to use for the purposes described above the data allowing the geographical positioning of the Vehicle to be determined. Only the services of Atlanti Camper will have access to this data as well as any person having a right of access under the law. These data will be kept for the duration of the Contract and, if necessary, of the investigation.

In accordance with the legal provisions, the Tenant has:

  • A right of opposition to the recording on a file and the use of his personal data;

  • A right to access, rectify and delete information concerning him, by sending his request, accompanied by proof of identity, by mail to: Atlanti Camper, 17 rue de la Guillauderie, 44118, LA CHEVROLIERE.
